New Delhi, 04 August (City Times) : (Gyanvapi Complex) In a significant development, the Supreme Court dealt a blow to the Anjuman Intezamia Masjid Committee by refusing to stay the Allahabad High Court’s directive for the Archaeological Survey of India (ASI) to conduct a survey of the Gyanvapi mosque complex in Varanasi.
A three-judge bench, led by Chief Justice of India (CJI) Dr. Dhananjaya Yeshwant Chandrachud, made it clear that the survey must be conducted using non-invasive methods, ensuring no excavation or damage occurs to the mosque’s walls or structure.
The Supreme Court upheld the Allahabad High Court’s order, emphasizing the ASI’s role in preserving historical monuments without causing any harm to their integrity.
The Court granted all parties the right to file objections to the ASI survey and took note of Solicitor General Tushar Mehta’s assurance that no damage would occur to even a single brick of the mosque.
Representing the Masjid Committee, senior lawyer Huzefa Ahmadi raised concerns about frivolous claims for ASI surveys, but the CJI responded that what may seem frivolous to one party could be a matter of faith to others. The Court asserted its commitment to safeguarding the interests of all parties and ensured no harm would be done to the mosque premises.
