UCC Bill Uttarakhand : In a significant move towards legal reform, Chief Minister Pushkar Singh Dhami presented the Uniform Civil Code (UCC) bill in the Uttarakhand Assembly, signaling a comprehensive overhaul of laws pertaining to marriage, divorce, succession, and live-in relationships. The legislative agenda aims to address various facets of civil life, setting new precedents and regulations.

A pivotal provision within the proposed UCC Bill mandates the compulsory registration of live-in relationships under the law. Couples engaging in live-in arrangements will be required to register their union within one month from the commencement of their relationship. Additionally, obtaining parental consent will be a prerequisite for adults choosing to enter into such arrangements.

Equality and Protection: Ensuring Rights for Women

The UCC Bill underscores principles of equality and protection, advocating for the eradication of child marriage and the implementation of uniform divorce procedures. Notably, women from all religious backgrounds will be granted equal rights in matters pertaining to ancestral property, marking a significant stride towards gender parity and empowerment.

Age and Registration: Uniform Standards for Marriage

Standardizing the age of marriage across all communities, the UCC Bill stipulates 18 years for women and 21 years for men as the legal age for marriage. Furthermore, the legislation mandates the compulsory registration of marriages across all religions, with unregistered marriages deemed invalid. Additionally, a one-year prohibition on filing divorce petitions after marriage is introduced to encourage stability in marital relationships.

Acknowledging the cultural diversity within society, the UCC Bill allows for the solemnization of marriages through various religious and customary rites and ceremonies. From Hindu rituals like “Saptapadi” to Islamic traditions like “Nikah,” the legislation respects and accommodates diverse matrimonial practices, fostering inclusivity and cultural sensitivity.

Protection of Tribal Rights

While presenting a comprehensive legal framework, the UCC Bill also upholds the constitutional rights of Scheduled Tribes and communities with protected customary practices. Provisions within the legislation ensure that the proposed reforms do not infringe upon the rights enshrined under Part XXI of the Constitution, safeguarding the distinct cultural heritage of these communities.

Aligning with PM Modi’s Vision

Chief Minister Dhami expressed confidence that the enactment of the UCC Bill would align Uttarakhand with Prime Minister Narendra Modi’s vision of “One India, Best India.” The legislative initiative reflects the government’s commitment to inclusive governance, aiming to cater to the diverse needs and aspirations of the populace.

The introduction of the UCC Bill fulfills a significant electoral promise made by the BJP to the people of Uttarakhand during the 2022 Assembly polls. The legislation represents a culmination of the party’s commitment to transformative governance and societal reform, addressing key issues affecting the lives of citizens.

The genesis of the UCC Bill dates back to March 2022 when the Dhami government constituted a committee tasked with drafting the legislation. This strategic approach underscores the government’s meticulous planning and consultative process in formulating a comprehensive legal framework.

Upholding Principles of Equality and Justice

As Uttarakhand prepares to embark on a new chapter of legal reform, the introduction of the UCC Bill signifies a significant step towards promoting equality, justice, and social cohesion. The legislation, with its emphasis on registration, protection of rights, and cultural sensitivity, reflects a progressive approach to governance. By aligning with Prime Minister Modi’s vision of national unity and inclusivity, the state stands poised to set new benchmarks in legislative innovation and societal transformation.
